1. Definitions

"HBG" means Harrison Barratt Group Pty Ltd (ABN 81 638 914 824) and any related entities.

"Client" means any person, company, or organisation that engages HBG to provide labour hire, recruitment, or managed payroll services.

"Worker" or "Candidate" means any person supplied by HBG to a Client or registered with HBG for work opportunities.

"Assignment" means any period during which a Worker is supplied to a Client by HBG.

"Services" means the labour hire, permanent recruitment, managed payroll, or other workforce services provided by HBG.

2. Scope of Services

HBG provides workforce solutions including but not limited to:

  • Labour Hire — supply of temporary and contract workers to Clients for specified assignments
  • Permanent Recruitment — sourcing, screening, and placing candidates in permanent positions
  • Managed Payroll — end-to-end payroll administration for Client-directed workers

Specific service terms, rates, and conditions will be detailed in the relevant service agreement or schedule between HBG and the Client.

3. Labour Hire Terms

3.1 Employment Status

All Workers supplied by HBG remain employees of HBG (or its relevant employing entity) for the duration of their assignment. HBG is responsible for all employment obligations including payroll, superannuation, workers' compensation, and PAYG tax withholding.

3.2 Client Obligations

The Client agrees to:

  • Provide a safe working environment compliant with all applicable WHS legislation
  • Conduct site-specific inductions and provide appropriate personal protective equipment (PPE)
  • Supervise and direct Workers during the assignment
  • Notify HBG immediately of any incident, injury, or safety concern involving a Worker
  • Not assign Workers to tasks outside the scope agreed with HBG
  • Approve timesheets promptly and accurately

3.3 Charge Rates & Invoicing

Charge rates are as per the agreed rate schedule. Invoices are issued weekly and payment is due within 14 days of invoice date unless otherwise agreed. HBG reserves the right to charge interest on overdue accounts at 2% per month.

3.4 Transfer Fees

If a Client offers direct employment to a Worker supplied by HBG within 6 months of the last assignment, a transfer fee will apply as outlined in the service agreement. This fee compensates HBG for recruitment, training, and administrative costs.

4. Permanent Recruitment Terms

4.1 Placement Fees

Permanent placement fees are calculated as a percentage of the candidate's first-year total remuneration package (base salary plus superannuation) as agreed in the service agreement.

4.2 Guarantee Period

HBG provides a replacement guarantee for permanent placements. If a placed candidate leaves or is terminated within the guarantee period (as specified in the service agreement), HBG will source a replacement candidate at no additional fee, subject to the terms and conditions of the guarantee.

4.3 Candidate Ownership

Candidates introduced by HBG remain the intellectual property of HBG for 12 months from the date of introduction. Any engagement of an introduced candidate — whether direct, through a third party, or in any other capacity — within this period will attract a placement fee.

5. Workplace Health & Safety

HBG is committed to maintaining the highest standards of workplace health and safety. All Workers are inducted, verified, and equipped to work safely. However, the Client acknowledges that as the person conducting a business or undertaking (PCBU) at the workplace, they have primary WHS obligations for Workers while on their site.

HBG maintains current workers' compensation insurance for all Workers and carries public liability insurance.

6. Licensing

HBG holds all required labour hire licences in each state and territory where it operates:

7. Confidentiality

Both parties agree to keep confidential all proprietary information, business strategies, pricing, candidate information, and client details disclosed during the course of the engagement. This obligation survives the termination of any agreement.

8. Limitation of Liability

To the maximum extent permitted by law, HBG's liability arising out of or in connection with the supply of Workers or Services is limited to the fees paid by the Client for the relevant Service in the 3-month period preceding the claim. HBG is not liable for any indirect, consequential, or special damages.

9. Termination

Either party may terminate a labour hire assignment by providing reasonable notice (minimum 4 hours for same-day, 24 hours otherwise). Service agreements may be terminated by either party with 30 days' written notice, unless otherwise specified. Termination does not affect any accrued rights or obligations.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

11.1 Staff Dashboard

The Staff Dashboard is provided for the convenience of HBG workers to submit pre-start checklists, dockets, injury reports, availability updates, and career information. By using the Staff Dashboard you acknowledge that:

  • Profile information may be stored locally on your device for convenience — you are responsible for the security of your own device
  • Form submissions are transmitted to HBG and stored in our secure cloud database
  • Uploaded documents (photos, certificates, attachments) are stored securely and may be accessed by authorised HBG personnel
  • You must provide accurate and truthful information in all submissions
  • HBG may use submitted information for compliance, payroll, safety, and operational purposes

11.2 Progressive Web App

This website may be installed on your device as a web application ("Add to Home Screen"). The installed app is subject to the same terms as the website. HBG does not guarantee uninterrupted availability of the web application and is not responsible for any data loss resulting from device failures or browser cache clearing.
